Regulators Florida Public Service Commission has decided to intervene in a lawsuit between utility Florida Power & Light Co. and company Albert Litter Studios Inc. The utility is being sued in a class-action suit for overcharging its customers by using thermal demand meters that gave faulty readings.

The Florida Public Service Commission will file an amicus brief with the US District Court in Miami, saying that it has rules that cover the meters, customer complaints and refunds. However, Albert Litter believes the case should be settled by a judge and jury; because the monetary damages could be higher than the PSC is able to offer in terms of its regulatory rules.

The thermal demand meter issue has been ongoing for the past couple of years. FPL has filed a motion to dismiss the lawsuit, saying that it agrees with the PSC’s decision.
