The class-action suit against Florida Power & Light Co. will not be heard before state regulators but will remain under the jurisdiction of the courts. The suit is as a result of accusations of overcharging commercial customers who used thermal demand meters, made by a utility consultant some two years ago.
FPL had wanted the Florida Public Service Commission to settle the issue. The PSC has indicated that it has rules which cover the meters, customer complaints and refunds. The judge said he had taken this into account when denying FPL’s request to dismiss the suit, and the utility is considering options, which could include an appeal against the ruling.
